TERMS AND CONDITIONS
1. SURFACE & PROPERTY DAMAGE WAIVER (READ CAREFULLY)
Customer acknowledges that roll-off containers, delivery trucks, and loading equipment are heavy and may exert significant surface pressure. Customer authorizes Hauler to place the roll-off container upon Customer's driveway, parking lot, or specified drop zone.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CUSTOMER EXPRESSLY WAIVES ALL CLAIMS AND RELEASES HAULER, ITS OFFICERS, DRIVERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL LIABILITY FOR DAMAGE TO DRIVEWAYS, ASPHALT, CONCRETE, BRICK PAVERS, CURBS, SIDEWALKS, LAWNS, TREES, SHRUBS, IRRIGATION/SPRINKLER SYSTEMS, UNDERGROUND SEPTIC SYSTEMS, SEWER PIPES, DRAIN LINES, OR UTILITY MAINS RESULTING FROM PLACEMENT, LOADING, OR REMOVAL OF THE CONTAINER.
Customer understands that placement on soft ground, lawn, unpaved surfaces, or aged concrete carries inherent risk of cracking, ruts, or depressions. While Hauler utilizes reasonable care and offers optional protective driveway boards/pads upon request, Customer assumes sole responsibility for ensuring the designated drop-off surface can safely bear the combined weight of the truck and loaded container (up to 30,000+ lbs).
2. PROHIBITED & HAZARDOUS MATERIALS
Customer agrees that ONLY non-hazardous municipal solid waste, construction & demolition (C&D) debris, or household junk as agreed upon shall be placed into the container. Under NO circumstances shall Customer deposit, place, or permit the placement of the following Prohibited Items:
• Hazardous waste, chemical waste, toxic substances, or biohazards
• Wet wet-paint, thinners, solvents, resins, adhesives, or lacquers
• Motor oil, transmission fluid, gasoline, diesel, or automotive fluids
• Car/truck batteries, lithium-ion battery packs, or acid-containing cells
• Asbestos, lead-based materials, or contaminated soil/sludge
• Propane tanks, compressed gas cylinders, oxygen tanks, or fire extinguishers
• Freon-containing appliances (refrigerators, AC units, freezers) unless pre-authorized
• Tires, fluorescent light tubes, large electronic waste (e-waste)
• Medical, infectious, or biological waste
FINES & PENALTIES: If prohibited materials are detected upon dumping at the transfer station or landfill, Customer agrees to pay a $150.00 to $500.00 hazardous material processing surcharge per item, PLUS all government fines, remediation fees, and specialized disposal facility charges incurred by Hauler.
3. WEIGHT LIMITS & TONNAGE OVERAGE AUTHORIZATION
Each container size includes a designated base tonnage weight limit specified above. Customer acknowledges that all waste hauled is weighed on certified, state-calibrated scale systems at the disposal facility.
Customer authorizes Hauler to automatically charge the credit/debit card on file for any weight in excess of the included tonnage allowance at the agreed overage rate of $[____] per ton (pro-rated). Customer understands that rainwater, snow, saturated soil, concrete, brick, dirt, plaster, and sod absorb water and significantly increase weight. Customer is solely responsible for weight accumulated due to weather conditions.
4. FILL LEVEL & TRANSPORTATION SAFETY ("WATER LEVEL RULE")
State and federal Department of Transportation (DOT) safety regulations mandate that containers must be safely covered with an automated or manual tarp during highway transit. Customer agrees that waste materials MUST NOT exceed the top rim/lip of the container walls ("water level").
No materials may protrude above the container sides, hang over the edges, or prevent the tarp from securing flat. Hauler drivers are legally prohibited from transporting overloaded or unsecured containers. If a container is overloaded above the rim:
(a) The driver may refuse pickup until Customer levels the load; OR
(b) Hauler may charge an excessive fill labor fee of $[____] to safely adjust the debris.
5. SITE ACCESS & DRY RUN / TRIP FEES
Customer agrees to provide clear, unobstructed access to the container on scheduled drop-off and pick-up dates between 6:00 AM and 8:00 PM. Access requires a minimum clearance of 10 feet in width and 14 feet in vertical height, clear of tree limbs and utility cables.
DRY RUN FEE: If Hauler arrives for scheduled delivery or pickup and access is blocked by parked vehicles, locked gates, low-hanging wires, snowbanks, or overfilled debris, a Dry Run Trip Fee of $[125.00] will be automatically charged to Customer's card on file, and the service will be rescheduled.
6. RENTAL DURATION & EXTENSIONS
The container remains the exclusive property of Hauler. Customer acquires no ownership interest. If Customer requires the container beyond the included rental period, Customer must notify Hauler at least 24 hours prior to the scheduled pick-up date. Additional rental days will be billed at the standard extension rate of $[____] per day.
7. INDEMNIFICATION & HOLD HARMLESS
Customer agrees to defend, indemnify, and hold harmless Hauler from and against any and all liabilities, claims, lawsuits, damages, costs, losses, and legal expenses (including reasonable attorney's fees) arising out of or related to: (i) Customer's breach of this Agreement; (ii) improper loading, overloading, or placement of prohibited waste; or (iii) injuries to third parties or property damage resulting from unauthorized movement, relocation, or interaction with the container while on Customer's premises. Customer shall NOT push, tow, move, or relocate the container with personal vehicles or heavy machinery under any circumstances.
8. PAYMENT AUTHORIZATION & DELINQUENCY
Customer guarantees payment for all rental charges, extra days, dry run fees, tonnage overages, and hazardous disposal penalties. Customer provides express authorization for Hauler to charge the credit card, debit card, or electronic payment method submitted at the time of booking for any post-service overages and fees verified by scale receipts and timestamped photos.
Customer agrees to pay all collection costs, court costs, and reasonable attorney fees incurred by Hauler in collecting any delinquent balances, plus statutory interest of 1.5% per month (18% per annum) or the maximum allowable rate under state law.
9. GOVERNING LAW
This Agreement shall be interpreted and governed in accordance with the laws of the State of [YOUR STATE], without regard to conflict of law principles. Any legal proceedings shall be instituted solely in the county where Hauler's primary office is situated.
10. ENTIRE AGREEMENT & ACKNOWLEDGMENT
This Agreement constitutes the entire understanding between Hauler and Customer regarding roll-off dumpster rental services. By signing below or accepting container delivery, Customer certifies they have read, understood, and agreed to all terms, liability releases, and fee structures herein.

How to Enforce and Use This Dumpster Rental Contract in 2026
Running a roll-off hauling business without a legally binding agreement exposes you to tens of thousands of dollars in property damage lawsuits, unpaid overweight dump slips, and illegal hazardous waste dumping fees. Here is how top operators enforce each key clause:
Section 1: Property Damage & Photo Proof
Always have drivers snap timestamped photos of the driveway surface prior to placement and immediately after retrieval. This proves pre-existing cracks weren’t caused by your roll-off wheels.
RollOS equips your fleet with 1-tap dumpster driver routing software with photo proof so drivers take required pre-drop and post-pickup pictures directly from their mobile web browser.
Section 2: Prohibited Items & Invoicing
Never let a customer dump unauthorized hazmat or tires without clear recourse. When items are detected at the transfer station, bill remediation fees quickly.
Attach photo evidence and itemized surcharges using our companion itemized roll-off invoice sheet to eliminate customer confusion and card chargebacks.
Section 3: Weight Limits & Overage Math
Never let a customer pay only cash upfront without a secondary card pre-authorization. When an unexpected wet-mattress or brick load comes in 2 tons over, you need automatic billing rights.
Before invoicing disposal overages, verify exact tare and gross net weight on our free dumpster tonnage calculator to guarantee dispute-proof scale math.
